Terms of service

Version 2026-08-06.1-draft — effective August 6, 2026

Draft not yet reviewed by a lawyer. Published for review: do not rely on this version.

This is a courtesy translation. In case of divergence the Italian version prevails.

You may use the service to assess your organisation's digital maturity. Your answers stay yours; the questionnaire, the scoring method and the report format are ours, and you may not republish or reconstruct them. The result is a working tool, not professional advice and not a guarantee of any outcome.

Who we are and what you are accepting

The service is provided by [[DA CONFERMARE: ragione sociale del titolare]], [[DA CONFERMARE: sede legale completa]], [[DA CONFERMARE: P. IVA / C.F. / n. REA]].

By using the service you accept these terms. If you do not accept them, you may not use it. How we handle your personal data is described separately, in the privacy notice, which is not a courtesy annex: please read it.

Who may use the service

The service is intended for people acting in the course of their professional activity, on behalf of the organisation they belong to. You must be at least 18.

[[DA CONFERMARE: if access is also open to individuals acting as consumers, this section and those on liability and jurisdiction must be rewritten.]]

Accounts and security

You agree to provide a valid email address you control, and not to share your credentials. Actions taken from your account are treated as yours: if you suspect unauthorised access, write to [[DA CONFERMARE: indirizzo email per le richieste privacy]] and we will revoke active sessions.

We may suspend an account that is compromising the security or availability of the service, telling you as soon as reasonably possible.

Companies and administrators

When you join a company, some actions are the company’s rather than yours, and are taken by whoever holds an administrator role: access to the company report, member management, and involving an external consultant.

Anyone accepting an administrator role represents that they have authority to act for the organisation in these matters, and takes on the responsibility of telling colleagues what the company can see. We do our part by showing each person, before they answer, what will be visible — but inside the organisation the responsibility is the organisation’s.

Content and intellectual property

Yours is what you enter: questionnaire answers, free text, the data describing your organisation. You grant us the right, limited to what running the service requires, to process it and include it in results according to the consents you have given.

Ours are the questionnaire and its wording, the structure of questions and options, the scoring rules, thresholds, interpretive models, insight texts, the report format, and the software that runs them. They are the substance of the service and they are not in the public domain.

We grant you a non-exclusive, non-transferable right to use your organisation’s report within that organisation, including copies made for day-to-day work. We do not grant you the right to republish it as your own product or to use it to build a competing service.

In particular you agree not to extract, copy or systematically reconstruct the questionnaire or the scoring method — including indirectly, for example by completing the questionnaire repeatedly with answers constructed to infer the rules, or by automated means. The technical protections we apply raise the cost of doing this; this clause also makes it a breach.

Acceptable use

You may not: use the service for unlawful purposes; attempt to access other people’s data; probe, overload or circumvent technical limits and security controls; submit defamatory or discriminatory content, or content infringing others’ rights; or claim an identity or company affiliation that is not yours.

In free-text fields, do not enter special-category data (health, political or religious opinions, trade-union membership, sexual orientation) or third parties’ personal data: the field is not intended to collect them.

What the report is

The report is an orientation tool. It rests on what you tell it, so it is worth exactly as much as the candour and competence of whoever answers. It is not professional advice, not a certification, not an expert appraisal, and it promises no financial outcome.

Automated indications should be read by someone who knows the context before they become decisions. Any business decision taken downstream of the report remains the organisation’s.

Availability and liability

We do what we reasonably can to keep the service available and the data intact, but we do not guarantee uninterrupted or error-free operation. We may interrupt the service for maintenance and may change its features.

To the extent permitted by law, we are not liable for indirect damages, lost profits, lost opportunities, or loss of data you could reasonably have kept elsewhere. Nothing in this section excludes liability for wilful misconduct or gross negligence, or any liability that the law does not allow to be excluded.

[[DA CONFERMARE: any liability cap, and its consistency with the B2B contract with the client company.]]

Term and termination

You may close your account at any time from your account page: closing it deletes your data as described in the privacy notice.

We may close or suspend an account for material breach of these terms, having given you an opportunity to remedy it where the breach is remediable.

The clauses on intellectual property, liability and governing law survive termination.

Governing law and jurisdiction

These terms are governed by legge italiana.

[[DA CONFERMARE: competent court. An exclusive jurisdiction clause must be checked against the status of the parties and mandatory rules.]]

The Italian version of this document is the binding one; translations are provided for convenience.
